Terms and Conditions

1. Introduction

  • Purpose: Clearly state that these terms and conditions govern the use of your basketball personal training services.
  • Service Provider: Mention your name/business name, location, and contact details.

2. Definitions

  • Provide definitions for key terms, such as:
    • Trainer: The personal trainer providing basketball training services.
    • Client: The person receiving the training services.
    • Session: A training session.
    • Package: Prepaid set of sessions.

3. Services

  • Training Programs: Outline what the training includes (e.g., individual sessions, group sessions, conditioning, skill development).
  • Duration of Sessions: Specify the length of each session (e.g., 60 minutes).
  • Location: Mention where the sessions will take place (gym, court, virtual, etc.).

4. Booking and Payment

  • Booking Process: Describe how clients can book sessions (via email, phone, website, etc.).
  • Payment Methods: List the accepted payment methods (credit cards, cash, bank transfer, etc.).
  • Pricing: State the cost per session or for packages, and outline any discounts or promotions.
  • Cancellation and Rescheduling: Define how clients can cancel or reschedule sessions and any fees for late cancellations (e.g., 24-hour notice required).
  • No Show Policy: Specify if there is a fee for missed sessions without prior notice.

5. Client Obligations

  • Punctuality: Clients should arrive on time for their scheduled sessions.
  • Health and Safety: Clients must inform you of any health conditions or injuries prior to training.
  • Appropriate Attire: Clients should wear proper athletic gear and footwear.

6. Trainer's Responsibilities

  • Professional Conduct: Trainers must maintain a professional demeanor and provide high-quality instruction.
  • Safety: Trainers are responsible for maintaining a safe training environment.

7. Liability and Waivers

  • Assumption of Risk: Clients acknowledge that basketball training carries inherent risks, and they participate at their own risk.
  • Liability Limitations: Limit your liability for injuries or accidents during sessions, except where negligence is proven.
  • Waiver of Liability: Include a clause that releases you from liability for injuries sustained during training (a waiver of liability form can be used here).

8. Confidentiality and Privacy

  • Confidential Information: Clarify that any personal information shared will remain confidential and be used only for the purposes of training.
  • Data Protection: Ensure compliance with privacy laws regarding client data (GDPR, etc.).

9. Termination of Services

  • Termination by Trainer: State the conditions under which you may terminate training (e.g., non-payment, inappropriate behavior, violation of policies).
  • Termination by Client: Specify how clients can end the agreement, including any required notice.

10. Indemnification

  • Clients agree to indemnify and hold you harmless from any claims, damages, or expenses arising from their participation in training sessions.

11. Governing Law

  • Indicate the legal jurisdiction that governs the agreement (typically your state or country).

12. Modification of Terms

  • State that you reserve the right to modify the T&C at any time, with notification to clients.

13. Contact Information

  • Provide clear contact details for any inquiries or disputes regarding the T&C.

Summary

By booking a session with Clays Nation, you agree to the following terms: sessions are booked on a first-come, first-served basis and must be paid in full before training. Cancellations must be made at least 24 hours in advance, or a cancellation fee will apply. You acknowledge that basketball training involves certain risks and agree to participate at your own risk. Please arrive on time and bring appropriate gear for your session. Our liability is limited to the maximum extent allowed by law. 

Non-Refundable Policy

A nonrefundable policy for a basketball personal trainer typically means that once you've paid for a session or package of sessions, you won't be able to get your money back, even if you cancel or miss an appointment. This policy is often put in place because personal trainers block out time specifically for you. If you cancel last-minute or don’t show up, they may not have time to fill that slot with another client.

In general, these policies help trainers protect their income and maintain their schedule, as their time is valuable. Some trainers might offer rescheduling options or a grace period for cancellations, but the payment itself is still nonrefundable.
